# India Regulatory Watch — Sexual Wellness

**Research date:** 28 August 2026

## Critical commercial point

India's treatment of sexual-wellness devices is not a simple "legal / illegal" proposition. Import enforcement has recently been contested in multiple High Court proceedings, particularly around Customs Notification No. 1/1964 and whether imported devices are prohibited as obscene articles.

The Delhi High Court proceedings in 2025 show that Customs has detained or seized products it considered sex toys and has asked CBIC to develop a policy position. In October 2025, the Court recorded that CBIC intended an inter-ministerial consultation concerning similar products, including sex toys. This creates a material import-risk variable for an India-first inventory model.

## Implication for alphaindianman.shop

Do not place a large import order merely because a supplier offers a very low MOQ or attractive factory price.

Before importing inventory, obtain a written customs/legal classification assessment for the exact product and proposed import structure. Maintain documentary evidence for product description, materials, intended use, tariff classification and supplier documentation.

## Marketing / presentation

The business should avoid gratuitous explicit imagery and claims. Product presentation should be sophisticated, adult-only and focused on sexual wellness, product functionality, quality, safety and informed adult choice.

## Medical / health claims

CDSCO states that drugs, cosmetics and medical devices in India are regulated under the Drugs and Cosmetics Act and related rules. A product that falls into a regulated medical-device or drug category must not be treated as an ordinary lifestyle product simply because it is sold through an e-commerce website.

Therefore:

- no disease-treatment claims without regulatory basis;
- no unsupported claims about curing sexual dysfunction;
- no pharmaceutical/medicinal claims for supplements or herbal products without a separate regulatory review;
- exact classification should be checked before listing products that make therapeutic claims;
- product pages should distinguish manufacturer claims from evidence-backed claims.

## Herbal medicines, nutraceuticals and supplements

These should be a separate research and compliance workstream. They have materially higher regulatory, quality, adverse-event and claims risks than simple consumer devices. The commercial plan should not assume that an attractive factory price makes such products suitable for launch.
